Terms of Use and Confidentiality

CONFIDENTIALITY AGREEMENT

This Agreement describes the rights and responsibilities of the WEBSITE and its USERS defined below; and the USERS who have accessed the WEBSITE declare that they have read this agreement and have fully accepted the rights and responsibilities therein.

DEFINITIONS

The abbreviations used in this agreement are as follows:

COMPANY: It refers to “Tan Sağtürk Bale ve Dans Eğitimi TV ve Film Prodüksiyon Organizasyon, Danışmanlık ve Ticaret Limited Şirketi”, the official owner of the site./p>

WEBSITE: It refers to the website with the domain, http://www.tansagturkakademi.com.

VISITOR: It refers to those individual(s) who visit the website for information purposes without providing personal contact information or those individual(s) who, at their own consent, provide their personal information to the website owner, i.e. the COMPANY, using the forms on the website. They shall be hereinafter referred to as "USER".

CUSTOMER: It refers to the persons or institutions who use the services mentioned on the website for a fee and who provide their personal and corporate information with their consent for this purpose. They shall be hereinafter referred to as "USER".

ARTICLES

Confidentiality

This WEBSITE is responsible for protecting the confidentiality of the USER. However, since it is a known fact by the USER accessing the WEBSITE that security is never fully achieved on the Internet, this responsibility covers the highest level of confidentiality that can be provided under the conditions required by the online environment.

The WEBSITE undertakes that they respect the privacy rights of USERS and shall reserve all the information that the USER provides to the WEBSITE.

However, the WEBSITE shall not be held liable for any damages that may be incurred by individuals or organizations owing to the legal or illegal acts of third parties.

All USERS accessing the WEBSITE shall be deemed to have declared that the COMPANY has read, understood and accepted this Confidentiality Agreement. The USERS who do not accept the terms of this Agreement in whole or in part for any reason should not use, and leave, the WEBSITE. The USERS who access and continue to use the WEBSITE shall be deemed to have accepted all the articles of this Agreement.

Personal Information

In the event that a USER sends a question or a request through the WEBSITE, the COMPANY may request or store the personal information of the USER (name, phone number, e-mail address and/or social media/messaging account ID) for the purposes of performing any product-service promotions, advertisements, communication, sales, marketing and membership procedures, information and applications via the mandatory fields on the forms.

The USER's contact information provided to the COMPANY may be used for advertising and promotional purposes via e-mail, SMS and direct mail that may be sent to the USER by the COMPANY. In addition to the call center acting on behalf of the COMPANY and the COMPANY, personal information and/or sensitive personal data may be recorded, saved, stored, periodically controlled, classified, updated, rearranged and otherwise processed via all channels, including but not limited to the affiliated COMPANY or affiliates or the social media pages affiliated with the WEBSITE.

Within the scope of achieving of the objectives stated in this Confidentiality Agreement, the COMPANY may share any personal information obtained from the USER with the affiliated COMPANY and its affiliates, the domestic and foreign business partners, for the purposes of website hosting, data analytics, customer services, order processing, payment transactions, credit card transactions, and provision information technologies; and the same share with third party service providers and suppliers who provide relevant infrastructures, e-mail sending, audit and similar services; or disclose such information to those parties and transfer it abroad.

The COMPANY may use this personal information which the USER consents to be used for the following purposes:

  • Offering the services provided by the COMPANY.
  • Responding to the questions of the USERS.
  • Within the scope of the marketing communication activities of the company, communicating all kinds of written and visual content such as announcements and newsletters that may be of interest to the USER according to the communication preferences of the USER.
  • Offering products, services, offers, advertising & marketing messages and content exclusive to the USER.
  • Enabling participation in surveys, sweepstakes, contests and similar promotions (THE COMPANY may apply additional rules that contain further information on how the personal information of the USER is used or disclosed in some of these activities; therefore, it is important that the USER reads the rules carefully, as recommended by the COMPANY.)
  • Providing customer services from the purchase by the USER (payment, order delivery, etc.) to contact with the USER regarding their purchases.
  • Fulfilling the business objectives of the COMPANY including, but not limited to, performance and expansion of business activities, service development, improvement or replacement, developing new products, testing, determining usage trends, determining the effectiveness of promotional campaigns, data analysis, inspections, crime/fraud monitoring and prevention and security.
  • Conducting all financial processes (e.g. accounting, billing, reconciliation and collection).

In addition, conducting all kinds of activities to the extent of, and consistent with, the purpose of this agreement.

The USERS may access and update their contact information and preferences by using one of the following methods regarding use of their personal information with marketing purposes. USER may also forward their requests regarding the access, update, deletion or correction of the personal information shared with the COMPANY, by using the communication form on the WEBSITE or sending a letter to the COMPANY’s address at "19 Mayıs Cad. No: 43 Fulya / Şişli, Istanbul". The COMPANY will fulfill the request(s) as soon as possible in accordance with the applicable legislation.

Unless required by law or legally authorized, personal information of the USER shall be retained by the COMPANY for the time period necessary for it to fulfill the purposes set out in this Confidentiality Agreement This period is maximum twenty years.

By applying to the COMPANY in accordance with the Law on the Protection of Personal Data No. 6698, the USER is entitled to:

(a) Find out whether their personal data has been processed;

(b) Request information if their personal data has been processed;

(c) Find out the purpose of processing their personal data and whether it has been used in accordance with the intended purpose;

(d) Be informed about third parties to whom the personal data has been transferred domestically or abroad;

(e) Make a request for correction in the event that the personal data has been processed deficiently or inaccurately;

(f) Request the deletion or disposal of their personal data;

(g) Request that the transactions made pursuant to the requests referred to in (e) and (f) above be notified to third parties to which personal data is transferred;

(h) Contest the outcome resulting against the individual himself/herself due to the analysis of the processed data via automatic systems; and

(i) Claim indemnification if the individual suffered damages due to the processing of their personal data in breach of the applicable law

Non-Personal & Compiled Information

When the USER visits the WEBSITE, general information is saved such as the IP used to access the WEBSITE, the pages visited on the website, how much time is spent on each page, information form and on the application. The purpose of keeping this information is to regularly monitor and improve website and the services of the COMPANY. This information is usually received via using IP addresses that are not linked to personally identifying information.

Cookies

The COMPANY or its partners may occasionally send “cookies” to the USER's computer.

These cookies are small pieces of data sent to web browsers by the web server and stored in the computer’s memory.

Cookies cannot provide data from the computer’s memory or cookie files created by other web pages.

Cookies do not damage the USER's system.

Cookies are used to track the pages and parts visited or edited by the USER. With cookies, repeated visits to the site by the USER are made easier.

The USER has the option to not accept cookies by changing the settings of the internet browser, or cause the browser to alert them when a cookie is sent to the computer.

If the USER returns browser settings to the default mode, all cookies are accepted automatically.

In the event that the USER rejects cookies, the functionality of those applications used on the site and other websites of the COMPANY may be restricted and some features may not work as desired. The COMPANY is not responsible for such reduction in functionality and disruptions.

Data Safety

In order to prevent unauthorized access to the site, maintain data accuracy and ensure appropriate use of information, physical, electronic and managerial procedures, all protecting the information collected through the website and ensure security, are implemented.

Despite all those measures in place, the COMPANY cannot guarantee that personal information will not be obtained illegally from the systems of the COMPANY. Therefore, the USER accepts all risks and responsibilities that may arise, including the risk of security in their system, if they use the COMPANY's online services.

Information Provided on the Website

The COMPANY reserves the right to make changes and/or restrictions on the content, design and access of the WEBSITE without prior notice. The COMPANY may, for any reason and at its sole discretion, restrict or suspend access to the WEBSITE.

The COMPANY makes every effort to keep the WEBSITE content current and accurate, but does not guarantee the accuracy of this information and assumes no responsibility for the accuracy, completeness and accuracy of this information. Use of this information is at the discretion of the USER and is not legally binding.

Linked Websites

This WEBSITE contains links that redirects USERS to other websites whose contents are not controlled by the COMPANY. These linked websites may contain terms different than the confidentiality provisions set forth in this agreement. The Company shall not be responsible for the compilation, use or disclosure of personal information collected by these websites. The COMPANY shall not be held liable for damages resulting from such compilation, use or disclosure. The fact that links to other websites are available on the COMPANY’s website shall not mean that those websites are safe; and the sole responsibility for those risks shall rest with the USER.

When the USER clicks on a link that redirects to external websites, they acknowledge that they have left the scope of responsibility held by the COMPANY since these websites are prepared by the third parties; and that the COMPANY does not have any liability whatsoever after they have done so.

The COMPANY is not liable for any direct or indirect damages, losses or expenses which may arise from any errors, interruptions, delay in information transfer, computer virus, line and electrical failure during the use of the WEBSITE.

Similarly, the COMPANY is not in any way liable due to the fact that such links are not controlled when a link is given to the COMPANY website from other websites regardless of the consent of the COMPANY.

The COMPANY owns all the copyrights on the website information, materials and modification thereof. All copyrights, trademarks, patents, intellectual property and other proprietary rights of the WEBSITE materials are reserved by the COMPANY. A third party and/or organization may not use the whole or a part of the WEBSITE on any other websites or establish a link to another website unless it has obtained the permission of the COMPANY in advance.

Amendments to Agreement

This agreement may be changed from time to time and amended without any prior notice by the COMPANY.

The change(s) made to the terms of use shall become effective as of the date of their placement on the WEBSITE.

It is the responsibility of the USER to check the current terms of use.
